Man charged with DUI manslaughter after crashing into bicyclist in Tampa, police say

TAMPA — A 48-year-old Tampa man was arrested on a DUI manslaughter charge after crashing into a bicyclist on East Dr. Martin Luther King, Jr. Boulevard late Sunday, police said.

Wayman Jerald Pearson II was driving a 2010 Acura ZDX in the outside westbound lane near North 15th Street about 11:50 p.m. Sunday when crash happened, according to an arrest report. The right front of the Acura struck the bicyclist who was riding west near the curb in the same lane, the report says. The bicyclist was thrown into the Acura’s windshield and landed on the pavement, police said.

The bicyclist died at the scene. His name is redacted from the arrest report obtained from the Hillsborough County jail. The Hillsborough County Sheriff’s Office and the Tampa Police Department are withholding the names of all crime victims because of the agencies’ interpretation of a new state constitutional known as Marsy’s Law.

A Tampa police spokesman said the bicyclist is a Tampa man in his 60s.

After the crash, Pearson drove for about three blocks and then turned around and returned to the scene, the report says.

Two witnesses told police Pearson was driving the Acura at the time of the crash.

An officer noticed a strong odor of alcohol on his breath, his eyes were bloodshot and glassy and his speech was slurred, the report says. Pearson refused to perform field sobriety exercises and insisted he was “going straight,” but later said that he had been drinking and provided a breath sample that showed his blood alcohol level was .129, according to the report. Under Florida law, a driver is presumed impaired under at .08 or higher.

“During the entirety of contact with the defendant, he never showed any emotion or concern, nor did he question the condition of the bicyclist,” the report says.

Pearson, of Tampa, was arrested at 12:45 a.m. Monday and was being held without bail in the Hillsborough County jail. Jail records show he is a driver for Waste Pro USA.
