Miramar Man Facing Murder Charge in Woman’s Fentanyl Overdose Death

A Miramar man was indicted Thursday on a murder charge in the death of a Miami woman who overdosed on fentanyl he had sold her, prosecutors said.

Bernard Gonzalez, 58, is facing a first-degree murder charge in the March 21 death of 31-year-old Kelly Fitzgerald, the Broward State Attorney’s Office said in a news release.

Fitzgerald was found dead at her home in Miami after ingesting fentanyl and derivatives of fentanyl that were purchased from Gonzalez at his apartment in Miramar, prosecutors said.

Gonzalez was arrested earlier this year on multiple charges, including armed trafficking of oxycodone and possession of a weapon by a convicted felon. He has remained jailed while that case is pending.

Gonzalez is the first person in Broward to be charged under a recently enacted Florida statute that charges those who give drugs that prove fatal murder charges.

“The law requires prosecutors to prove that the defendant supplied the drugs to the victim and that the drugs were the proximate cause of her death,” the state attorney’s office release said.

If convicted, Gonzalez faces up to life in state prison.
